What the user should know about Cookies

Technical cookies will be exempt from compliance with the obligations established in Article 22.2 of the LSSI when they allow the provision of the service requested by the user, as is the case with the cookies listed in the previous paragraphs. However, if these cookies are also used for non-exempt purposes (for example, for behavioral advertising purposes), they will be subject to these obligations.

Preference or Personalization Cookies

Preference or personalization cookies are those that allow remembering information so that the user can access the service with certain characteristics that may differentiate their experience from that of other users, such as, for example, the language, the number of results to display when the user performs a search, the appearance or content of the service based on the type of browser through which the user accesses the service or the region from which they access the service, etc.

If it is the user themselves who selects these characteristics (for example, if they choose the language of a website by clicking on the flag icon of the corresponding country), the cookies will be exempt from the obligations of Article 22.2 of the LSSI, as they are considered a service expressly requested by the user, provided that the cookies serve exclusively the selected purpose.

Analytical or Measurement Cookies

Analytical or measurement cookies are those that allow the controller to track and analyze user behavior on the websites to which they are linked, including the quantification of ad impacts. The information collected through these cookies is used to measure website, application, or platform activity, with the goal of making improvements based on the analysis of user data.

This type of cookies, although they are not exempt from the obligation to obtain informed consent for their use, were noted by GT29 as unlikely to pose a risk to user privacy, provided they are first-party cookies, process aggregated data for strictly statistical purposes, provide clear information on their usage, and include the option for users to refuse their use.

Behavioral Advertising Cookies

Behavioral Advertising Cookies are those that store information about user behavior, obtained through the continuous observation of their browsing habits, allowing the development of a specific profile to display advertising based on that profile.
